I have the honour to acknowledge the receipt of Your Lordship's despatch No.88 dated the 28th March,
1930, on the subject of the claims of the British section
of the Kowloon-Canton Railway for compensation from the
Chinese section in respect of suspension of traffic and
demurrage and to enclose a memorandum by the Crown
Solicitor on these claims.
It must be admitted that there is some doubt as
to the authentic text of the working agreement, the article quoted by His Majesty's Minister in paragraph 4 of his despatch of the 14th December, 1929, being differently worded from the corresponding article in the copy relied
upon by this Government and bearing a different number (No.32 in the Minister's copy and 38 in the Government's copy).
But the differences are verbal only and not material to the present issue and the fact remains that the
Chinese section has at no time taken the action
contemplated by Article 32 (or 38) i.e., suspended the
